美國航空鐵路罷工少 專法規範嚴
基於鐵路與航空的特殊性，美國立有「鐵路勞動法」，專責規範鐵路與航空勞資糾紛處理，降低罷工可能。這讓美國的航空公司極少發動罷工，最近一次是在8年多前的精神航空。
中華航空機師突襲式罷工，讓不少趁著春節年假出國旅遊民眾的行程受到影響。由於機師工會僅給予6小時預告，引發不少爭議。
基於鐵路正常營運的重要性與對經濟影響，美國早在1926年就立有「鐵路勞動法」（Railway Labor Act）專責規範鐵路勞資談判、仲裁、調解與罷工。這項法規在1936年擴大適用到航空公司員工。
這項專法與美國勞動法的最大不同在於，鐵路與航空業必須進行集體談判。勞資糾紛必須透過調解、仲裁等方式解決，且必須所有方法用罄才得以就重大糾紛進行罷工，否則法院得以介入禁止罷工。
原則上，爭議由勞資雙方協商，如果談判破裂，得進行調解或仲裁，透過由總統任命的國家調解委員會（NMB）介入協調。如果仍無法解決爭議，且可能導致大規模交通運輸中斷，總統得成立緊急委員會，在30天內進行調查。在調查期間與確定僵局無解後的30天內，勞資兩方都不得進行罷工或類似行動。
由於法規明確，美國鐵路與航空業儘管常有勞資糾紛，工會也常以罷工威脅，但國家調解委員會考量經濟損失與旅客權益會強力介入，即使無法達至最後協議，但多半能讓勞資雙方放棄罷工念頭，重啟談判，這讓美國航空業罷工情況確實較其他行業來得少，但也不是不曾發生。
最近一次美國的航空公司機師罷工，發生在2010年。當時規模仍小的廉價航空精神航空公司（Spirit Airlines）機師與公司就薪資待遇展開長達3年多的談判未果後，發動罷工。罷工僅進行5天，就在勞資達成協議，航空公司同意逐年調高機師待遇後，宣告結束。
在精神航空之前的另一場機師罷工則發生在2001年5月，由達美航空（Delta Airlines）於1999年併購、現已關閉的柯麥爾航空（Comair）機師發起。當時柯麥爾航空是全美第2大國內線航空公司，機師要求比照達美航空機師待遇未果，1350名機師發動大規模罷工，最後達美航空同意調高機師薪資待遇，才結束這場長達2個半月的罷工行動。
